Sales and Refund Policy
1. Introduction
This is a legally binding user agreement (“Sales and Refund Policy”) between Tactus Ventures Incorporated, hereinafter referred to as (“We/we”, or “Us/us” or “Our/our” or “Company/company” or “Tactus”) having its registered office address at 16192 Coastal Highway, Lewes, Delaware 19958, Country of Sussex, USA and user(s) hereinafter referred to as (“You/you” or “Your/your”). The Sales and Refund Policy contained herein on this associated/partnered mobile application (collectively “Application”). These terms apply in full force and effect to your purchase from the Application, and you expressly accept all Return and Sales Policies contained herein in their entirety. You must not purchase Smart shoes manufactured by Tactus (hereinafter referred to as “Product” or “Products”) from the Application, if you have any objection to any of these terms. We reserve the right to unilaterally change, modify, add or delete portions of the Sales and Refund Policy at any time, without prior notice. Please review the terms periodically for changes. Your continued use of the Application and purchase from Tactus shall mean that you accept all such changes or deletions.
2. Standard Return Policy
Tactus fundamentally believes that you will be thrilled with the products you purchase from the Application. That’s because we go out of our way to ensure that they’re designed and built to be just what you need. We understand, however, that sometimes a product may not be what you expected it to be. In that unlikely event, we invite you to review the following terms related to returning a product.
a.
Undamaged Product: For any undamaged product, you may return it with its included accessories and packaging along with the original receipt (or gift receipt) within _______ days from the date you receive the product, and we’ll exchange it or offer a refund based upon the original payment method. In addition, please note the following:
i.
Products can be returned only in the country or region in which they were originally purchased.
ii.
For returns to Tactus for cash, cash equivalent, and check transactions over Tactus will mail a refund check to you within ______ Business days.
b.
Opened or Activated Software: In a situation where you have opened and activated the software attached to the product which has a software license on its packaging, Tactus shall not be liable to accept return requests for such products. However, you may return the Tactus-branded software if you do not agree to the licensing terms but you may not retain or otherwise use any copies of returned software.
c.
Opened or Activated Security Features: Tactus provides security features to enable you to protect your product in case of loss or theft. In a situation where you have activated these security features and the person in possession of the phone is unable to disable it, Tactus may at its sole discretion refuse your return or exchange request.
d.
Wireless Service Cancellation: Wireless carriers attached to the products have different service cancellation policies. Returning your respective products to the Tactus in itself may not automatically cancel or reset your wireless account, hence, you are responsible for your wireless service agreement and for any applicable fees associated with your wireless account. Please contact your wireless service provider for more information.
3. Procedure for Return or Refund Request:

4. Unauthorized modifications
Making unauthorized modifications to the software attached on the products violates the software license agreement. The common term for modifying the products is jail-breaking, with a particular emphasis on the second part of that term. Hence, Tactus strongly recommends you do not do so. In a situation where you are unable to use your products due to an unauthorized software modification, its repair will not be covered under the warranty provided by Tactus.
5. Pricing and Price Reductions/Corrections
Tactus reserves the right to change prices for products displayed on its Application for purchase at any time, and to correct pricing errors that may inadvertently occur. In a situation where you have been charged more than the posted price for a product on the Application, please contact Tactus on ___________ for a refund of the overcharge.
Prices shown are in INR. If you are paying for your order with an international Visa, MasterCard, or American Express credit card, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees.
6. Order Acceptance/Confirmation
Tactus may, in its sole discretion, depending on its stock, refuse or cancel any order and limit order quantity. Tactus may also require additional qualifying information prior to accepting or processing any order. Once Tactus receives your Online order from the Application, it will provide you with an email confirming your order. Your receipt of an order confirmation, however, does not signify Tactus’ acceptance of your order, nor does it constitute confirmation of Tactus’ offer to sell; Tactus is simply confirming that it has received your order. The Tatus reserves the right at any time after receiving your order to accept or decline your order for any reason. If Tactus cancels an order after you have already been billed, Tactus will refund the billed amount by way of the original payment mode used by you.
7. Shipping & Delivery
The tentative date of shipping and delivery will be notified to you once you place an order on the Application. However, such date is only a tentative date and Tactus in no way assures delivery to you by such date. Since the actual delivery of your order can be impacted by many events beyond, Tactus cannot be held liable for late deliveries as it may be beyond its control. Tactus will, however, cooperate to ensure a smooth delivery of your products.
As Tactus takes care of the dispatch of the products you purchase from the Application, the risk of loss of, or damage to, product(s) shall pass to you when you, or a person designated by you, acquires physical possession of the product(s). Title in the product(s) shall pass to you when the product(s) is picked up by the carrier from our warehouse. At this point, you will receive the Shipment Notification Email. If there are any issues with delivery, please contact Tactus on __________ to resolve the same.
8. Product Availability and Limitations
Given the popularity and/or supply constraints of some of our products, Tactus may have to limit the manufacturing and number of products available for purchase on its Application. However, Tactus will put in its best efforts to build it as fast as it can. As mentioned herein, Tactus reserves the right to change quantities available for purchase on the Application at any time, even after you have placed an order. Furthermore, there may be occasions when Tactus confirms your order but subsequently learns that it cannot supply the ordered product due to a shortage. In such an event, Tactus may not be able to supply the products you ordered by you, Tactus shall then cancel your order and process a refund of your purchase price in full by way of the original mode of payment.
9. Consumers Only
Tactus sells and ships products to end-user customers only, and it reserves the right to refuse or cancel your order at its sole discretion, if it suspects that you are purchasing products for resale or any commercial use.
